The Amparo Trial is the main instrument to defend human and fundamental rights against acts of authority. It can be initiated when authorities violate rights contained in the Political Constitution of the United Mexican States or fail to protect, respect, and guarantee these rights. There are two types:

  • Indirect Amparo: This is filed before the District Courts or, exceptionally, before the Circuit Courts, regulated by the Amparo Law. It mainly consists of two instances, known as bi-instance amparo.

  • Direct Amparo: Handled by the Collegiate Circuit Courts, also governed by law. It is typically resolved in a single instance, known as uni-instance amparo.
